By Accessing the website of Swift-Exchange.Com or performing any transactions, the user agrees that he/she is of legal age in their country to sign legally binding contracts.

The user is solely responsible to provide valid and accurate information needed to complete Swift-Exchange.Com orders.

Users must be aware that transfer into the wrong account as a result of wrong account number being given by the user are irreversible. Users are fully responsible for providing the right account number to prevent transfer into wrong account.

All Swift-Exchange.com orders are binding contracts between the user and Swift-Exchange.Com and must be honored at all times.

We reserve the right to refuse service to particular individuals or entities, at our sole discretion, with or without cause. NO correspondence will be entered into.

We reserve the right to report any fraudulent or suspicious activity to the appropriate authorities.

Swift-Exchange.Com will transfer the amount of e-currency in your chosen currency applying the exchange rate current at the time of the spend.

Orders cannot be cancelled once e-currency has been transfered to the user's e-currency account.

Swift-Exchange.Com reserves the right to delay transfer for any reason.

Swift-Exchange.Com will protect its members' privacy and will only disclose any customer information if it is ceased by the government authorities or requested by court by subpoena. Swift-Exchange.Com may choose to contact its customers at any time while processing and verifying the order information. Additional contact details, apart from those provided in the order form (including a copy of the photo ID), may be required.

If the customer cancels the order before it is completed and requests the funds to be returned, Swift-Exchange.Com will only refund the funds to the originating account (e.i. the wire will be reversed to the originator’s account, in case of the exchange between e-currencies, the fund will be returned to the account from which we have received the spend). Swift-Exchange.Com would not refund the money to a third party account or a new account opened specifically to receive the refund. Further proof of identity and ownership of funds may be required.

The same refund policy will apply when Swift-Exchange.Com chooses to refuse any order.

Members must supply valid identification documents to accompany their membership application. Documents must be clear copies of a current Passport or Drivers Licence, along with a recent utility bill or bank statement. Other means of identification or documentation may be requested by Swift-Exchange.Com at any time. Members must supply a valid landline telephone number in which Swift-Exchange.Com staff can call to verify membership contact and order details. We reserve the right to cancel pending memberships and orders if we are unable to make contact. Mobile phone or Internet phone numbers are not permitted. This is a due diligence requirement to avoid fraud and illegal activity (including Money Laundering). As we are a money service business we are required by financial regulations to perform these KYC (Know Your Customer) tasks.

Swift-Exchange.Com is independently operated and is neither endorsed by nor affiliated with any E-Currency provider. In the event of any questions about our service and/or your order, you should contact us directly using the contact page of the web site.

Swift-Exchange.Com may at any time alter this Terms of Service agreement and any of its services offered. Customers will be informed on the website of any changes. Previous obligations to Swift-Exchange.Com customers will be met.

All transactions into or out of or between accounts of E-Currencies shall be subject to the Terms & Conditions of those E-Currency providers as outlined on their respective web sites.

Swift-Exchange.Com will not be responsible for delays or failures in the transmission, receipt or execution of orders, remittances, payments, or information due to events or systems beyond its control. The obligations of this contract precede any government enactment. Swift-Exchange.Com, its owners, employees, agents or affiliates will not be responsible for any loss, damage or injury resulting from any event or system beyond its control.

Swift-Exchange.Com will not fulfil any exchange transactions ordered by the user if the user uses, or attempts to use Swift-Exchange.Com in connection with tampering, modifying or otherwise corrupting the security or functionality of the Swift-Exchange.Com. Additionally, the user will be subject to damages and other penalties, including criminal prosecution where available and the notification of the general public of the user's actions, at the sole discretion of Swift-Exchange.Com.

Swift-Exchange.Com will not fulfil any exchange transactions placed by the user, if ordered not to do so by an order from a court or arbitration body of acceptable jurisdiction or official body or group such as a Market Makers Association, or E-Currency provider such as Liberty-Reserve or AlterGold for example, or as determined by Swift-Exchange.Com.

The user is solely and completely responsible for the E-Currency account given in any order to Swift-Exchange.Com and the contents and disposal of contents thereof. Swift-Exchange.Com will not be held responsible for the use or disposal of the value or contents of any E-Currency. This especially includes investment programs. We are not affiliated to, nor do we endorse investment programs. If our banner or link appears on any such program this is merely an advertisement of our services. We stress the danger involved in any such programs and suggest extreme caution before transferring any amount of Gold or Silver to them.

Security

Swift-Exchange.Com takes the security and privacy of its systems and its customers' data very seriously. We constantly review our systems and data to ensure the best possible service to our customers. Swift-Exchange.Com will investigate any breach of security with a view to prosecuting and/or taking civil proceedings to recover damages against those responsible.

Restrictions of Service

Customer agrees that Swift-Exchange.Com is not an investment company. It does not offer or solicit any investment opportunities. Swift-Exchange.Com also does not act as an escrow service, it is not a party to any third party transaction taking place at the auction or otherwise where are e-currencies are being used as a method of payment.

Customer agrees, that there are certain risks involved when buying, selling or exchanging electronic currencies. Swift-Exchange.Com does not endorse any of the e-currency issuer or any company whose products are sold by Swift-Exchange.Com, nor does it audits or checks these companie's financial information.

Customer indemnifies Swift-Exchange.Com and all its employees, affiliates, subsidiaries and holding company from any liability in the event if the e-currency issuer does not deliver upon its promise to provide the service associated with maintaining the e-currency accounts.

Customers should obtain an independent legal and financial advice if they have questions or doubts in relation to the services provided by Swift-Exchange.Com.

LIMITATION OF LIABILITY

UNDER NO CIRCUMSTANCES WILL SWIFT-EXCHANGE.COM BE LIABLE FOR ANY DAMAGES CAUSED TO CUSTOMERS OR TO ANY THIRD PARTIES EITHER DIRECTLY OR INDIRECTLY. THIS INCLUDES BUT NOT LIMITED TO THE LOSS OF / STOLEN PAYMENTS.

Order processing policy

To avoid mistakes and to prevent any possible fraudulent activity, the following policy is implemented to process all orders submitted to us.

1. All orders must be submitted through the system by completing the appropriate online order form. Orders placed without the form being fully completed, may or will not be processed.

2. Do not make any payments into our accounts without prior submission of the order form. Such payments and payments that do not match the orders in our system will be held pending investigation.

3. Buy order form must be completed in full with real e-mail address and real phone number provided. Phone number must contain country and area code. Do not use cellular phones and Internet fax numbers. Orders submitted without these details may not be accepted or delayed.

4. As part of the verification process customers may be required to provide a copy of their photo ID.

5. Order, once placed, cannot be split or re-directed, i.e. if you placed the order to buy Liberty-Reserve, the payment you have made cannot be used to buy Pecunix on behalf of another account, etc. And, for example, If you are buying $50 worth of Liberty-Reserve, we will spend it to the account you nominated in your order, we cannot split it into 2 different accounts.

6. Checks and Money orders are not accepted.

7. Third party transfers are not accepted, unless you can prove that it is made by your company or under your instructions and the transfer has the reference to your order and your name.

8. Swift-Exchange.Com is in business of exchanging e-currencies and associated services, we do not provide or solicit any other goods or services.

9. By placing the order you indemnify our company of any liability which may arise as the result of fraudulent activity by a third party or mistakes as result of incorrect information being provided or any other circumstances not under our direct control.

Conclusion

These terms are governed by International law. By accessing this website you consent to these terms.
